Nursing Home Falls and Fractures

Suing Nursing Homes for Fall Injuries

Nursing homes are supposed to have the resources to provide round-the-clock care and attention to residents who are unable to get up and about on their own. When they fail to live up to that responsibility, serious falls and fractures can be the unfortunate result.

If your parent or other loved one has been injured in a fall at a nursing home, a negligence lawsuit may help you get answers about how the accident happened, hold the responsible party accountable, and prevent similar accidents from happening to others.

Understanding the Causes of Falls and Fractures

There are many different circumstances where nursing home residents who are infirm are potentially at risk for falling and fracturing bones. Among the most common situations where falls occur are the following:

  • Getting up to go to the bathroom
  • Transferring from the bed to a wheelchair
  • Standing up from a wheelchair
  • Walking across the dining room
  • Getting into bed

Nursing homes are legally required to conduct risk assessments for new residents and take certain precautions based on those assessments. If a resident is at a high risk for falls and fractures, he or she is supposed to have assistance with all transfers and travel.

Identifying How the Nursing Home Was Negligent

Nursing homes that do not conduct proper risk assessments, provide staff at regular intervals to help residents get around, or send people to promptly respond to call lights are committing neglect and can be held accountable for injuries that occur as a result.

Fractures are the most common injuries suffered in falls. While a fracture is a serious injury for anyone, it can be particularly serious for someone who is in a nursing home.
