Standing Up for Your Rights and Driving Privileges
If you have been arrested for DWI in Missouri, you should call a criminal defense attorney at the first available opportunity. Until you have consulted a lawyer, you should avoid answering any questions or making any statements to the police or prosecutors.
In many parts of Missouri, including Kansas City, you have a right to refuse the breathalyzer test and cannot lose your license solely because you didn't take the test.
If you took the test and failed it — or, in other parts of the state, if you refused the test — you have 15 days to request a hearing to save your driver's license. Otherwise, it will automatically be suspended through an administrative process.
If your license is suspended, I may be able to help you get a hardship license so you can drive to work or take your kids to school. If and when you get your license back, you may need to use an ignition interlock device, which requires you to take a breath test before driving.
